Uppie Yuppy Inc. Participation Waiver, Release of Liability, Hold Harmless, and Indemnification Agreement

IMPORTANT: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.

In consideration for being allowed to enter and use the play areas, inflatable equipment, and/or participate in any activities, events, parties, or programs at Uppie Yuppy Inc., I, the undersigned, agree to the following terms on behalf of myself and the minor child(ren) listed below (hereafter referred to as “Participant(s)”):

1. Authority to Sign

I affirm that I am the parent or legal guardian of the Participant(s) listed below, or I have received express permission from the parent or legal guardian to sign this agreement on their behalf.

2. Acknowledgment of Risks

I understand and acknowledge that participation in activities at Uppie Yuppy Inc., including use of play areas and inflatable equipment, involves certain inherent risks, including but not limited to:

• Minor injuries such as cuts, bruises, bumps, and scrapes
• Serious injuries such as fractures, sprains, or head trauma
• Emotional distress
• Permanent disability or death

These risks may arise from the actions or inactions of the Participant(s), other guests, or staff.

3. Voluntary Participation and Assumption of Risk

I voluntarily choose to allow the Participant(s) and/or myself to participate, fully aware of these risks. I accept full responsibility for any injury, illness, loss, or damage that may occur. I also acknowledge risks may arise from other participants' behavior, which I willingly assume.

4. Agreement to Follow Rules

I agree that the Participant(s) and I will comply with all safety rules, policies, signage, and instructions provided by Uppie Yuppy Inc. staff. Failure to comply may result in removal from the premises without refund.

5. Waiver and Release of Liability

On behalf of myself, the Participant(s), my spouse, heirs, personal representatives, and assigns, I hereby waive, release, and forever discharge Uppie Yuppy Inc., its owners, officers, employees, agents, affiliates, parent companies, and successors from any and all claims or causes of action for injuries, damages, or losses (including those arising from alleged negligence) incurred during participation.

6. Indemnification

I agree to defend, indemnify, and hold harmless Uppie Yuppy Inc. and its representatives from any and all claims, liabilities, costs, or damages, including attorney’s fees, resulting from the Participant(s)' participation in activities at the facility.

7. Fitness to Participate and Legal Capacity

I certify that the Participant(s) and I are physically and emotionally fit to safely participate in all activities. I further declare that I am of sound mind and legal capacity to enter into this agreement voluntarily and without coercion.

8. Severability

If any part of this agreement is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

9. Understanding and Consent

I have read, understood, and voluntarily agreed to the terms of this waiver. I have had the opportunity to ask questions and seek clarification before signing.

10. Acknowledgment of Health Risks

I understand and acknowledge that by entering a public facility such as Uppie Yuppy Inc., I and the Participant(s) may be exposed to contagious illnesses, including but not limited to COVID-19, influenza (flu), the common cold, RSV, and other viral or bacterial infections.

I voluntarily assume all risks associated with such exposure on behalf of myself and the Participant(s), and I agree to release, hold harmless, and not hold liable Uppie Yuppy Inc., its owners, employees, affiliates, or agents for any illness, injury, or health-related issue that may result from participation or presence at the facility.

11. Responsibility for Damages

I agree that I am financially responsible for any damage to property, equipment, or the facility caused by the Participant(s) under my care, whether accidental or intentional. This includes, but is not limited to, damage to inflatables, toys, furniture, walls, restrooms, or any other part of Uppie Yuppy Inc. I understand that Uppie Yuppy Inc. reserves the right to assess and collect payment for repairs, replacements, or cleaning directly from me as the parent or legal guardian.
